The Last Words: Doctor’s role in Dying Declaration
[1] Dying decleration is a statement made by a person who is conscious and knows that death is imminent , and the statement is concerning the cause or circumstances of his death.
[2] It can be recorded by any person who is present at the time, even a doctor, or nurse.
[3] There is no requirement for any lawyer, police officer, or magistrate to be present at the time of the declaration.
[4] It is admissible in court as evidence, because the law believes that a dying man would not lie.
[5] They are crucial pieces of evidence in criminal cases, particularly in cases of murder and suicide.
[6] This does not mean the entire verdict will be based entirely on just this statement.
[7] The statement can be oral or written.
[8] If it is an oral statement, it is advisable for the doctor/nurse to document the dying declarations, to avoid any errors or omissions.
[9] It is important to also document the date, time, and place of the declaration.
[10] By recording dying decelerations we can help ensure that justice is served and the truth prevails.
