Possible solutions to the Problems in Rajasthan Right to Health Bill:
[1] To emulate schemes like Ayushmann Bharath scheme, or several state schemes where the Government has a tie up with various private institutions to provide for medical care on behalf of the state for which they would be compensated.
[2] But this agreement should be predetermined, with Pre-determined procedures/services included and fixed rates. Importantly institutions should have the choice of entering this agreement only if they desire to.
[3] If the Government intends to include all emergency care inclusive of diagnostic tests etc, then it can determine a fixed amount that any patient is entitled to obtain in case of any medical emergency.
[4] The above points are already in force in various states through certain state schemes.
[5] Most of such state schemes are restricted to certain citizens, like those having a BPL card or with income below a certain amount.
[6] If the government wants to extend this to all citizens, it would be a considerable financial commitment which the government must be capable of honouring. The state health budget should be increased accordingly.
[7] The government has to set a maximum limit for such emergency services it would compensate, and include hospitals accordingly. If Hospitals are free to charge any amount, then it could lead to misuse and over expenditure of taxpayer money.
[8] If the governments wants the RTH to extend to services in any healthcare facility, then they could make a provision instead that patients can avail the emergency services after payment of fees, and are entitled to a reimbursement from the government.
[9] In effect, this would a state health insurance, extended to all citizens free of cost, without any premium payment, but restricted to emergency medical services.
[10] This would allow for emergency care at every medical establishment to be accessed, and be the real test of the government’s resolve to help the citizens.
